Terms of Service

Agreeing to these terms

These Terms of Service are an agreement between you and the operator of Ozilai ("we", "us"). Using the service means you accept them. If you disagree with any part, please stop using the service. You can reach us at support@ozilai.io.

You must be at least 18 years old to buy credits, and at least the age of digital consent where you live to use the service at all.

What we offer

The service is a hosted software platform that turns a photo you upload into a short video clip. We can change, pause or retire any part of it, and where practical we will give fair warning first.

Independence from any player or club

Ozilai is an independent, fan-made tool. It is not affiliated with, endorsed by or sponsored by Mesut Özil, any club, league or broadcaster, and nothing on the service should be read as an official product or an approval from any of them.

Your account

Keeping your login details private is up to you, and so is everything that happens under your account. If you suspect someone else has used it or your security has been compromised, tell us right away.

Rules for using the service

You must not:

• Upload a photo of anyone without their permission, or of a minor without the consent of a parent or guardian.
• Use the service to impersonate a real person, a public figure, or a celebrity, or to present generated media as a real event, appearance, endorsement, or quote.
• Produce content that defames, harasses, sexualises or spreads hatred, or that is meant to deceive those who watch it.
• Break any law or regulation that applies to you, or infringe anyone's intellectual property or other rights.
• Try to reach our systems or data without authorisation, or disrupt how the service works.

Content that breaks these rules may be removed and the account behind it suspended.

Paying for the service

Paid features are charged in advance: monthly plans for the billing period you choose, credit packs once at the time of purchase. You must give accurate billing details. Prices, credit costs and what each plan includes are shown on the pricing page before you pay. Refund requests are decided according to our refund policy.

Your content and your clips

You keep ownership of the photo you upload and of the video generated from it.

To run the service we need a limited permission: by uploading a photo you allow us to store it, pass it to the video-model provider named in the Privacy Policy, and keep the resulting clip in your account so you can download it. That permission exists only to deliver the clip you asked for. It does not let us sell your photo, publish it, or use it to train any model of ours.

You confirm that you own or are entitled to use every photo you upload, and that you have the permission of anyone shown in it.

Who owns what

We own the service itself, along with its original content, features and functionality, all of which are protected by copyright, trademark and other intellectual property law around the world.

Copyright complaints and removal

If you believe content on the service infringes your rights, or that a clip uses a photo of you without permission, email support@ozilai.io with the clip or page link and enough detail to identify you. We will review the notice and remove or restrict the content where the complaint is upheld, and we will tell the person who uploaded it.

Ending access

If you break these terms, we may suspend or end your access. You can also ask us to close your account at any moment by emailing support@ozilai.io. Closing an account does not by itself entitle you to a refund; refunds follow the refund policy.

Limits on our liability

As far as the law allows, we are not responsible for indirect, incidental, special, consequential or punitive losses that arise from using the service or being unable to use it.

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded or limited. If you are a consumer, you keep all the rights your local law gives you, and nothing here overrides them.

Governing law

These terms are governed by the laws of Hong Kong SAR, and the courts of Hong Kong SAR have exclusive jurisdiction over any dispute arising from them. If you are a consumer living elsewhere, this does not remove the protection of the mandatory consumer law of the country where you live.

Revising these terms

We can amend these terms at any time. For significant changes we will update the date at the top of the page and, when appropriate, notify you inside the service. Continuing to use the service after a change means you accept the revised terms.
